刑事侦查中证实偏向的模拟研究——兼评刑事侦查中对证据的认定Study of Confirmation Bias in Criminal Investigations——Concurrent Comment on Evidence Decision in Criminal Investigation

摘要(Abstract):
从事刑事诉讼的人员可能会冒"证实偏向"或"隧道观点"的风险,即可能坚信犯罪嫌疑人有罪,而对其事实上是无辜的这一替代方案充耳不闻。这可能体现在进行有罪证实调查情况的偏好上,甚至反对旨在证实替代方案的调查活动。研究结果显示,额外调查证据的收集方向是通过对嫌疑人罪行的初步评估来确定的;参与者倾向于选择通过增加有罪调查来增加罪行的严重程度,并与目前案件卷宗中所掌握的证据有力程度有关;罪证调查的选择与定罪比率有关。
